Getting started

Five items, left behind on the bottle

Updated

On this page13
Dispenser, serial number and date, prescriber, patient, directions. A travel case has none of them.

The paragraph is an exemption

A drug dispensed by filling or refilling a prescription is exempt from the requirements of section 352, subject to stated exceptions.

And the exemption has a condition

If the drug bears a label containing five things. The exemption is not a status the drug has; it is available because of what is printed on the container.

Which inverts how people think about a pharmacy label

It reads as administrative detail attached to a lawful product. It is closer to the opposite: the detail is what makes the simplified labeling available.

The five

The name and address of the dispenser. The serial number and date of the prescription or of its filling. The name of the prescriber. If stated in the prescription, the name of the patient. And the directions for use and cautionary statements contained in the prescription.

All five live on the dispensed container

Printed on the label the pharmacy applied, which is attached to the bottle the tablets came in.

So moving the tablets leaves all five behind

A day organizer, a travel jar or a pocket tin carries none of them. The tablets are the same tablets and the label is not with them.

Which is the mechanism, and this property stops there

Nothing on these pages says whether decanting is permitted or what a patient may do with their own medication. That is not a container catalog's determination.

The useful reading is about dependency

A great deal in drug labeling depends on a condition being met by the package. The hazmat property finds the same structure around a mark and the preparedness property around a seal.

And the paragraph has exclusions as well as conditions

It excludes drugs dispensed through mail-order diagnosis and drugs dispensed in violation of the prescription requirements. Those are described here and the full set is in the statute.

Which is why the citation matters more than the summary

A conditional exemption with exclusions is exactly the kind of provision a paraphrase damages. The text is quoted and linked.

Then there is our own gap, and it is complete

One of this group's six leaves is a pill organizer, and there is no multi-compartment organizer anywhere in this catalog.

Six articles come close and none of them is one

3 glass vials, 2 polypropylene hinged containers and 1 phenolic hinged container, catalog-wide. Two of those are indexed to the aromatherapy group.

21 U.S.C. 353(b)(2). A drug dispensed by filling or refilling a written or oral prescription is exempt from the requirements of section 352 of the title, subject to stated exceptions, if the drug bears a label containing "the name and address of the dispenser, the serial number and date of the prescription or of its filling, the name of the prescriber, and, if stated in the prescription, the name of the patient, and the directions for use and cautionary statements, if any, contained in such prescription." The paragraph also excludes drugs dispensed through mail-order diagnosis and drugs dispensed in violation of the prescription requirements; those exclusions are described rather than quoted here, and the full set of exceptions is in the statute. Nothing on these pages says whether decanting a dispensed prescription is permitted. law.cornell.edu
The Davis Pack Supply catalog, searched catalog-wide on 19 October 2026. The only compartmented, hinged or vial articles in the entire catalog are 3 glass vials at 1.8 to 3.7 mL, 2 polypropylene hinged containers at 7.4 mL and 1 phenolic hinged container. None of the six is a multi-compartment pill organizer. The 2 polypropylene hinged containers are indexed to the aromatherapy group rather than to this one, which has a pill organizer leaf.
Written from 21 U.S.C. 353(b)(2) and from the catalog as it stood on 19 October 2026. Nothing here says whether decanting a dispensed prescription is permitted, or what a patient may do with their own medication; the point is that the exemption in that paragraph is conditional on a label the dispensed container carries. Airline and security screening rules are not federal drug law and are not addressed. The pocket threshold used on these pages, 3 inches in height and 1.8 inches in diameter, is a figure this property chose and not a standard. There is no multi-compartment pill organizer anywhere in this catalog.
