What goes wrong

The standard was read as a package rule

On this page12
Formulas are examined. The bottle is not in the sentence.

The presentation was treated as evidence

A 30 mL amber bottle with a graduated pipette is not a beverage presentation, and the standard is applied to a formula on a form.

A small fill was treated as evidence

Median capacity here is 30 mL. A small container does not make a formula unfit for beverage purposes and a large one does not make it fit.

The word tincture was treated as a finding

Tincture of ginger has been found to be fit for beverage use and is disapproved for drawback. The name carries nothing.

A pharmacopoeia listing was treated as a finding

The three named disapprovals in that paragraph are all pharmacopoeia preparations, which is exactly why the exception list is informative.

A drawback approval was read as a permission to sell

It is approval to recover federal excise tax on distilled spirits used. What may be sold is governed elsewhere.

Or as a safety finding

It is neither. Unfit for beverage purposes says nothing about whether a product is safe, and fit for beverage use says nothing either.

The spirits provision was applied to an oil

An MCT blend contains no distilled spirits, so the question does not arise. One of the five leaves here sits outside the spine entirely.

And the scope was assumed

Whether a cannabis or CBD preparation falls within part 17 is not addressed on these pages and should not be inferred from their being written.

State law was left out

As it is in every property in this library, because it differs by state and a national catalog cannot speak to it.

A percentage was read into it

There is no number in the sentence. Unfit for beverage purposes is a finding rather than a calculation, so there is no strength to engineer towards.

The fix is to submit the formula

There is a named form in the regulation, which means there is a body with a view. Reasoning about the bottle is not a substitute for asking.

27 CFR 17.131: "formulas on TTB Form 5154.1 shall be examined and, if found to be medicines, medicinal preparations, food products, flavors, flavoring extracts, or perfume which are unfit for beverage purposes and which otherwise meet the requirements of law and this part, they shall be approved for drawback." Part 17 is a drawback provision for recovering federal excise tax on distilled spirits used in nonbeverage products. It is a tax rule rather than a safety or packaging rule, and nothing here states whether a particular product is within its scope. law.cornell.edu
27 CFR 17.132(b), within a section headed U.S.P., N.F., and H.P.U.S. preparations: "Alcohol (including dehydrated alcohol and dehydrated alcohol injection), U.S.P.; alcohol and dextrose injection, U.S.P.; and tincture of ginger, H.P.U.S., have been found to be fit for beverage use and are disapproved for drawback." law.cornell.edu
Written from 27 CFR 17.131 and 17.132 and from the catalog as it stood on 19 October 2026. Part 17 is a drawback provision, a mechanism for recovering federal excise tax on distilled spirits used in nonbeverage products. It is a tax rule rather than a safety or packaging rule, and nothing here states whether any particular product is within its scope. Availability, quote-only and full-case figures are a single snapshot rather than a trend. The twelve 18DIN containers on this shelf have no matching closure on it.
