The label

What previously means

On this page11
Has previously been plainly marked. Not marked on arrival.

The marking offense is written in the past perfect and that is deliberate

Unless the container or package has previously been plainly marked, labeled, or tagged. The state of the package is assessed as at the moment the movement begins.

So a cure after the fact does not help

Marking a container on arrival does not undo the transport of an unmarked one. Which makes the offense complete at the start of the journey rather than at its end.

That is a different timing from every other label rule here

A care label must be findable when the product is offered for sale. A fiber content statement must be on the product at sale. A hazard label must be on a container leaving a workplace.

And one of those is looser in an instructive way

Under the hazard communication standard the label for certain solid materials may be transmitted to the customer at the time of the initial shipment and need not accompany later shipments at all.

So two federal rules about a shipped container take opposite positions

One requires the marking to be on the package before it moves, every time. The other allows the information to travel once to a customer and never again unless it changes.

The difference is what the marking is for

A Lacey Act marking identifies what is inside a container to somebody inspecting it in transit. A hazard communication label informs an employer who will receive many identical shipments.

Which is the general point and it recurs across these properties

The persistence and timing of a label requirement follow from who has to read it and when. A label for an inspector must be on the box. A label for a repeat buyer need only reach the buyer.

Four persistence horizons are now cataloged in this library

Until the package is empty, for most container rules. Once per customer relationship, under the hazard communication standard. Through distribution, sale and resale to the ultimate consumer, for wool products. And the useful life of the product, for a care label.

This one adds a fifth and it is the only one defined by a moment

Before the movement starts. Not a duration at all, which makes it a different kind of requirement from the other four.

And nothing on this shelf carries any marking at all

No container here arrives printed, labeled or tagged. Whatever identifies the contents of a jar of hooks is written on it by whoever filled it, which is the ordinary situation on a small parts shelf.

16 U.S.C. 3372(b): "Marking offenses. It is unlawful for any person to import, export, or transport in interstate commerce any container or package containing any fish or wildlife unless the container or package has previously been plainly marked, labeled, or tagged in accordance with the regulations issued pursuant to paragraph (2) of section 3376(a) of this title." law.cornell.edu
Written from 16 U.S.C. 3372 and from the catalog as it stood on 19 October 2026. That section is the Lacey Act prohibition and it makes a federal offense out of trade in fish, wildlife or plants taken in violation of other law; it does not govern hooks, swivels, sinkers or beads, and nothing here says it does. Nothing here states whether lead tackle is lawful in any jurisdiction, which varies and is not in this record, and nothing here is guidance about fishing or licensing. A closure recorded as fitting a container shares a neck notation in the supplier record, which is not a test of fit. This shelf is shared identically by nine groups and the sewing notions property enumerates the inventory.
