Borrowed law

A service deemed to be a sale

On this page11
For money or other consideration. And the offense is then a sale of wildlife.

One subsection converts a service into a commodity transaction

It is deemed to be a sale of fish or wildlife in violation of the chapter for a person, for money or other consideration, to offer or provide guiding, outfitting, or other services, or a hunting or fishing license or permit, for an illegal taking.

And the mirror provision covers the customer

It is deemed to be a purchase of fish or wildlife for a person to obtain those same services or a license or permit for an illegal taking, acquiring, receiving, transporting or possessing.

Which closes a gap the trade limbs would otherwise leave open

The trade limbs reach dealing in the animal. A guide who never touches the animal is dealing in access to it, and without this subsection that would sit outside the list of seven verbs.

The statute does not argue that a guiding service is a sale of wildlife. It directs that it be treated as one, which is a drafting device rather than a description.

Or other services is deliberately open

Guiding and outfitting are named and the category is then left wide. Which is consistent with the rest of the section, where the categories are drawn by function rather than by name.

And for money or other consideration covers a non-cash arrangement

A barter, a reciprocal favor or an in-kind payment is inside the provision. The test is whether value passed, not whether money did.

A license or permit sitting in the same list is the striking inclusion

Providing a permit for an illegal taking is deemed a sale of wildlife. Which puts a piece of paper in the same category as the animal it relates to.

The illegality still comes from somewhere else

For the illegal taking, acquiring, receiving, transporting or possessing. So even this subsection depends on another rule to say what is illegal, which is the pattern throughout.

Nothing in this subsection concerns packaging or hardware

It is set out because it shows how far the borrowing structure is carried: a service, a permit and an attempt all become offenses defined by a rule the section does not state.

And nothing here is guidance about any of it

No page on this property says anything about fishing, licensing, guiding or any take. This is a packaging catalog describing the shape of a statute and then returning to the shelf.

Written from 16 U.S.C. 3372 and from the catalog as it stood on 19 October 2026. That section is the Lacey Act prohibition and it makes a federal offense out of trade in fish, wildlife or plants taken in violation of other law; it does not govern hooks, swivels, sinkers or beads, and nothing here says it does. Nothing here states whether lead tackle is lawful in any jurisdiction, which varies and is not in this record, and nothing here is guidance about fishing or licensing. A closure recorded as fitting a container shares a neck notation in the supplier record, which is not a test of fit. This shelf is shared identically by nine groups and the sewing notions property enumerates the inventory.
