The word was assumed to describe the container
On this page13
Refillable was read as a physical property
It is a claim about whether the means for refilling is provided. A container anyone could refill is not refillable for this purpose.
So an unqualified claim was made with nothing behind it
Which is the first of the section's two examples: a container labeled refillable with no collection program established.
The second route was overlooked
Offer for sale a product that consumers can purchase to refill the original package. Which is a second SKU and is the ordinary route.
And the geographic condition was missed
The section's second example turns on larger bottles being available in the same market area. Availability is local.
The pesticide statement was confused with the claim
The pet grooming property quotes 40 CFR 156.140, which requires a refillable container to say so. That is a designation, not a marketing claim.
Which means one scheme compels the word and another restricts it
Both can reach one product, and they mean different things by it.
A pod was treated as a refill
A concentrate pod is single use by design and leaves nothing to refill, which is a different answer to the same problem.
And a pouch was looked for on this shelf
Three of the four leaves are not rigid containers. 55 articles catalog-wide carry pouch, bag, sachet or film in their family name and none is asserted to be a refill pouch.
The empty middle was read as a gap
57 containers under 120 mL and 26 over 946 mL. On this shelf the gap is the design rather than a shortfall.
And the metering question was left to the end
There is one twin neck dosing bottle in this group and 141 plain lids. A concentrate has to be measured by something.
Decide the system, then buy the two containers
Which is the order the section implies: the means for refilling first, the packages second.
And keep the claim out of the specification
Which is the lesson from our own Recyclable field. A claim that depends on facts outside the product does not belong in a product attribute.
