The same word, two schemes
On this page13
The pesticide scheme requires the statement
The pet grooming property quotes 40 CFR 156.140, under which a refillable container must bear "Refillable Container. Refill this container with pesticide only. Do not reuse this container for any other purpose."
So there the word is compulsory
If the container is a refillable one, the label says so. The statement follows from the container type.
Here the word is conditional
A marketer should not make an unqualified refillable claim unless the marketer provides the means for refilling the package.
Which looks like a contradiction and is not
The two schemes mean different things by the word. One is a designation of a container type and the other is a marketing claim to a consumer.
And they can both apply to one product
A pesticide in a refillable container bears the required statement, and any further refillable claim made in marketing is subject to the guidance.
The pesticide statement is restrictive on its face
Refill this container with pesticide only, and do not reuse it for any other purpose. It is a warning more than a benefit.
Where the marketing claim is a benefit
Which is why it needs the means to be provided. A benefit claim with nothing behind it is the thing the guidance addresses.
So read the word for which scheme is speaking
A designation, or a claim. The same seven letters doing two different jobs.
This is the second such pair in the library
The cider property restricts a fill to twenty-five values and the specialty property quotes a statute declining to limit size at all. Two provisions, opposite stances.
Which is the general lesson from both pairs
There is no federal position on a packaging question. There are schemes, and the scheme that reaches your product decides.
Find the scheme first
Before deciding whether a word is required, forbidden or conditional. Our data cannot tell you which scheme you are in.
And we record neither designation
The pet grooming property notes we publish no refillable or nonrefillable field. Nothing here changes that.
