Three tests

All or virtually all

On this page11
Made, manufactured, built, produced, created, crafted. And any other unqualified claim.

The definition does not describe a form of words, it describes an effect

Made in the United States means any unqualified representation, express or implied, that a product or service, or a specified component thereof, is of U.S. origin.

Express or implied is the phrase with the reach

So a claim that nobody wrote in those words is inside the rule if it conveys the same thing. The test is what a representation says to a reader, not which words were used.

Which is the second time this library has found a rule reaching an implication

The wool products rules prohibit any words, coined words, symbols or depictions connoting or implying the presence of mohair or cashmere where the term does not appear in the required disclosure. Two rules, two agencies, the same drafting problem solved the same way.

Then six verbs are named, and the list is explicitly not closed

Made, manufactured, built, produced, created, or crafted, in the United States or in America, or any other unqualified U.S.-origin claim.

Crafted is the one that matters for a gift and favor seller

It is the word a small producer reaches for first, and it is in the definition by name. Crafted in America is an unqualified United States origin claim and the three tests apply to it in full.

Or in America is the other half of that phrase

So the rule covers the country and the continent-scale name, which closes the obvious route of naming a region instead of a country.

Unqualified is the word that defines the boundary of the whole part

A qualified claim is outside this prohibition. Assembled in the USA from imported components is a qualified claim and says what it says, and the part is aimed at the claim that gives no such information.

And a specified component brings a partial claim inside the rule

A representation that a product, or a specified component thereof, is of U.S. origin. So a domestic-glass claim on an otherwise imported assembly is within the definition and the three tests apply to that component.

All three tests apply to whatever the claim was about

Which is the quiet consequence of that clause. Narrowing a claim to one component does not narrow the scrutiny; it moves it.

So the structure is wide at the trigger and strict at the test

Any implication, any of six verbs, any other unqualified claim, about a product or any specified component. And then three conditions reaching back through the whole supply chain.

16 CFR 323.2, Prohibited acts: "In connection with promoting or offering for sale any good or service, in or affecting commerce as “commerce” is defined in section 4 of the Federal Trade Commission Act, 15 U.S.C. 44, it is an unfair or deceptive act or practice within the meaning of section 5(a)(1) of the Federal Trade Commission Act, 15 U.S.C. 45(a)(1), to label any product as Made in the United States unless the final assembly or processing of the product occurs in the United States, all significant processing that goes into the product occurs in the United States, and all or virtually all ingredients or components of the product are made and sourced in the United States." law.cornell.edu
Written from 16 CFR part 323 and from the catalog as it stood on 19 October 2026. Part 323 is the Made in USA Labeling Rule and it governs an unqualified claim of United States origin; it imposes no labeling requirement on anybody who makes no such claim, and it does not reach any container on this shelf. The catalog records no country of origin for any product, so nothing here states the origin of anything or whether any product may be labeled Made in the USA. Nothing here is advice about origin claims or advertising. This shelf is a subset of the store-small-dry shelf and the sewing notions property enumerates that shelf in full.
