What a mark carries with it

On this page11
Seal, mark, tag, or stamp. Four graphic devices, and the three tests behind each one.

The mail order section reaches a graphic rather than a sentence

A seal, mark, tag, or stamp labeling a product Made in the United States. Which is how a domestic origin claim usually appears in a catalog: as a badge beside a photograph.

And a badge is by its nature unqualified

Which matters, because the part is aimed at the unqualified claim. A roundel has no room for assembled from imported components, so a badge is almost always the version of the claim that carries the full test.

A sentence can be qualified and a stamp generally cannot. Choosing a badge is therefore choosing the strictest form of the claim, which is a practical observation rather than a legal one.

Four devices are named and they differ in where they sit

A seal and a stamp are marks on a surface. A tag is attached. A mark is the general case. All four are inside the section.

And to the extent that is the limiting phrase

To the extent that any catalog includes such a device, that label must comply. So the section does not regulate the catalog; it regulates the claim within it.

Which is consistent with the rest of the part

Nothing requires a catalog to say anything about origin. The section specifies what happens when a catalog chooses to, in the setting where the buyer cannot examine the product.

A qualified claim sits outside the prohibition and inside section 5

Outside this part, because the definition covers unqualified representations. Still subject to the general prohibition on unfair or deceptive acts, because a qualified claim can also be misleading.

So the part is a floor rather than a ceiling

Satisfying it is not the end of the question, and the pages say so rather than implying that a qualified claim is free of scrutiny.

Nothing on this shelf carries any mark at all

No container in this catalog arrives printed, stamped, sealed or tagged with anything. Whatever a gift jar eventually says is said by whoever fills and labels it.

Which is the one honest connection between this spine and this group

A favor or a gift set is assembled from parts and then described to somebody who will not handle it before buying. That is the exact situation the definition of a mail order catalog describes.

16 CFR 323.1(b): "The terms mail order catalog and mail order promotional material mean any materials, used in the direct sale or direct offering for sale of any product or service, that are disseminated in print or by electronic means, and that solicit the purchase of such product or service by mail, telephone, electronic mail, or some other method without examining the actual product purchased." And 16 CFR 323.3, Applicability to mail order advertising: "To the extent that any mail order catalog or mail order promotional material includes a seal, mark, tag, or stamp labeling a product Made in the United States, such label must comply with 323.2." law.cornell.edu
16 CFR 323.1(a): "The term Made in the United States means any unqualified representation, express or implied, that a product or service, or a specified component thereof, is of U.S. origin, including, but not limited to, a representation that such product or service is “made,” “manufactured,” “built,” “produced,” “created,” or “crafted” in the United States or in America, or any other unqualified U.S.-origin claim." law.cornell.edu
Written from 16 CFR part 323 and from the catalog as it stood on 19 October 2026. Part 323 is the Made in USA Labeling Rule and it governs an unqualified claim of United States origin; it imposes no labeling requirement on anybody who makes no such claim, and it does not reach any container on this shelf. The catalog records no country of origin for any product, so nothing here states the origin of anything or whether any product may be labeled Made in the USA. Nothing here is advice about origin claims or advertising. This shelf is a subset of the store-small-dry shelf and the sewing notions property enumerates that shelf in full.
