Where we stop
On this page11
The six leaves
Amanita, blue lotus, delta-8, kava, kratom and mushroom extract. Each one raises a different ingredient question and this property answers none of them.
Not whether any of them is a dietary ingredient
The categories in the definition are broad and being in one of them is not a permission. The 1994 gate still applies.
Not whether any is a new dietary ingredient
That is answered from records of the American market before 15 October 1994, by ingredient and by form. We hold no such records.
Not whether either route is open
The food supply route and the 75-day notification route both turn on facts about the ingredient and its history, not on the container it goes in.
Not what federal agencies have said
Positions have been taken on several of these. Summarizing or characterizing them here would be worse than silence, because a summary on a packaging page reads as settled.
And not state law
Which differs from federal law and from state to state for several of these. A product lawful to ship from one state may not be lawful to receive in another.
Why the refusal is the honest content
A buyer arriving at a container page for one of these needs to know that the page is not an all-clear. Saying so plainly is more useful than hedged commentary.
What we will do
Quote the definition, quote the date, quote both routes, and describe the shelf accurately including what is out of stock.
Which leaves the real work where it belongs
With whoever is introducing the product, and with a professional who can assess a specific ingredient in a specific form.
The container decisions are separate and we can help with those
Mouth width, wall opacity, liner, headspace, case pack. All of them can be settled without an opinion on the ingredient.
