Pet CBD

We are not going to sell a dropper bottle into this without saying what the position is.

The structure of the problem

A new animal drug is any drug intended for use for animals other than man that is not generally recognized among qualified experts as safe and effective under the conditions in its labeling. A CBD product sold to treat a condition in an animal is squarely inside that description.

And then the deeming provision

A new animal drug is deemed unsafe with respect to that use unless an approval, conditional approval, index listing or authorization is in effect and the drug, its labeling and its use conform to it. Without one, the statute has already characterized the product.

FDA has not approved CBD for use in animals

Which is the fact that matters commercially. The absence of an approval is not a gap waiting to be filled by a careful label; it is the condition the deeming provision turns on.

The claim is what creates the drug

A product sold as a supplement with no therapeutic claim is in a different and more complicated place involving feed and supplement law rather than drug law. It is not a safe harbor either, and it is a question worth real advice.

Anxiety, pain and seizures are the claims to watch

They are the three this category is actually sold on, and all three are conditions. A calming claim is a claim about a condition however gently it is phrased.

State law is a separate layer

State feed control officials regulate animal food and supplement ingredients, and their position on hemp-derived ingredients varies. Clearing the federal question would not finish the exercise.

What we will say about the container

If you are packaging an oil dosed by drop, the dropper shelf is 60 glass containers with 40 dropper assemblies and it is a good shelf. We are not going to pretend the container is the hard part of this product.

Written from federal statute, not from a veterinary bench. Which regime a specific product falls under is a determination about that product, and state feed and drug programs run alongside the federal ones. Nothing here is a registration, an approval, or advice on a particular formulation.
