No substantiation file

How it happens
A good formula, happy test customers, and a launch. The substantiation requirement is not a gate anybody passes through, so a product can be on sale for a year before the question is asked.
What the regulation actually requires then
Either adequate substantiation prior to marketing, or the conspicuous statement on the principal display panel that the safety of the product has not been determined. There is no third state.
Which is why nobody ever sees that warning
Because the moment a business understands the choice, it does the substantiation. Seeing the sentence in the wild would be remarkable, and that is the rule working rather than the rule being unused.
Bath products have a high exposure profile
Whole body, warm water, often prolonged, often children. Any safety reasoning has to be built around that rather than around a leave-on product at the same ingredient percentage.
Supplier documentation is the starting point, not the end
An ingredient safety data sheet addresses handling, not consumer exposure in a bath. The ingredient-level and the finished-product-level questions are both required and they are different questions.
And it has to be prior to marketing
Which makes it part of the development timeline rather than a document to produce if asked. Building it alongside the formula is the only way it ends up dated correctly.
Keep it with the formula and the label version
So that a reformulation visibly reopens it. A substantiation file that describes a formula you no longer make is not a file, it is a historical document.
It is a development task, not a document task
Built alongside the formula it is a morning's work and it is correctly dated. Reconstructed after launch it is a project, and the date on it will not help you, because the requirement is substantiation prior to marketing rather than substantiation eventually.
